Today I received an email notification from my Sydney Property Lawyer Tony Cordato of something that is being added to Selling Agency Agreements by Real Estate agents. I thought I should bring it to your attention, so you don’t get caught out.
Mostly, the Selling Agency Agreement gives the Estate Agent an exclusive period of 90 days to sell the property commencing on the date the Selling Agency Agreement is signed. The Seller is locked in for 90 days.
However, this week Property Lawyer Tony Cordato was given a Selling Agency Agreement to advise upon which contained this paragraph:
I give (the Real Estate Agent) exclusive rights to sell the Property commencing today and expiring 90 days after the auction date.
By adding the words “after the auction date” they have added the 6 week auction period (42 days) to the 90 days and extended the exclusive period to 132 days.
So, please read the Selling Agency Agreement carefully and only sign it if it suits you.
